O estudo detém-se sobre o princípio do devido processo legal e a imparcialidade do árbitro, pilares essenciais para a segurança jurídica no procedimento arbitral. Examina-se a evolução da arbitragem no Brasil, sublinhando a necessidade de um estatuto jurídico claro para os árbitros, o que se mostra indispensável para garantir a legitimidade e a confiança das partes envolvidas no processo arbitral. O estudo objetiva demonstrar a aplicação do devido processo legal na arbitragem, investigando como a imparcialidade do árbitro afeta a segurança jurídica. Além disso, são explorados os princípios jurídicos fundamentais que sustentam a arbitragem, assegurando que esta seja um método equitativo e justo de resolução de conflitos. A tese baseia-se em fundamentação teórica, que inclui a análise das origens do devido processo legal, bem como da teoria da segurança jurídica e aos princípios específicos da arbitragem. Metodologicamente, a pesquisa adota uma abordagem qualitativa, valendo-se de análise documental, revisão de literatura especializada e estudo de casos relevantes. Essa dinâmica permite uma compreensão profunda e prática da aplicação dos princípios jurídicos e processuais na arbitragem. A imparcialidade do árbitro, conforme evidenciado na pesquisa, é garantida pelo dever de revelação, que obriga os árbitros a divulgarem as circunstâncias que possam suscitar dúvidas sobre sua imparcialidade. O controle jurisdicional das sentenças arbitrais, realizado pelos tribunais estatais, emerge como um mecanismo crucial para assegurar o devido processo legal e a segurança jurídica, reforçando a integridade do procedimento arbitral. A tese proposta oferece uma análise detalhada e crítica dos mecanismos que garantem a justiça e a equidade na arbitragem, contribuindo para o aperfeiçoamento deste método de resolução de disputas no cenário jurídico contemporâneo. Ao fim, o estudo não apenas elucida os contornos normativos e a aplicação do devido processo legal na arbitragem, mas também investiga como a imparcialidade do árbitro é essencial para a segurança jurídica, consolidando a arbitragem como uma ferramenta de justiça privada eficaz e confiável.The present work is a modest contribution to the understanding of arbitration as a dispute resolution mechanism in a globalized context. The study focuses on the principle of due process and the impartiality of the arbitrator, essential pillars for legal certainty in the arbitration procedure. It examines the evolution of arbitration in Brazil, emphasizing the need for a clear legal framework for arbitrators, which is indispensable to ensure the legitimacy and confidence of the parties involved in the arbitration process. The study aims to demonstrate the application of due process in arbitration, investigating how the impartiality of the arbitrator affects legal certainty. Furthermore, it explores the fundamental legal principles that underpin arbitration, ensuring that it is an equitable and fair method of conflict resolution. The thesis is based on theoretical foundations, including the analysis of the origins of due process, as well as the theory of legal certainty and the specific principles of arbitration. Methodologically, the research adopts a qualitative approach, utilizing document analysis, a review of specialized literature, and the study of relevant cases. The judicial control of arbitral awards, conducted by state courts, emerges as a crucial mechanism to ensure due process and legal certainty, reinforcing the integrity of the arbitration procedure. The proposed thesis offers a detailed and critical analysis of the mechanisms that ensure justice and fairness in arbitration, contributing to the improvement of this dispute resolution method in the contemporary legal landscape.
