Los efectos de la enfiteusis en los reinos peninsulares durante la Baja Edad Media : reflexiones sobre los derechos y obligaciones de las partes contratantes

Abstract

La enfiteusis, tanto en los reinos hispánicos como en el Reino de Portugal durante la baja edad Media, se configuró como uno de los sistemas típicos de propiedad y de explotación agraria de la Península ibérica. Se convirtió en la médula de numerosas “cartas pueblas” y pilar centrar de los señoríos jurisdiccionales. El presente trabajo tiene por finalidad resaltar la labor esta milenaria institución jurídica en la conversión de extensas superficies de tierras incultas e insalubres en fértiles cultivos y, por otro lado, conocer – conforme al derecho medieval hispano-luso - las principales notas características de la enfiteusis en cada territorio peninsular.

The emphyteusis, both in the Hispanic kingdoms and in the Kingdom of Portugal during the late Middle ages, was configured as one of the typical systems of ownership and agricultural exploitation of the iberian Peninsula. it became the marrow of numerous “cartas pueblas” and pillar centering of the jurisdictional lordships. The purpose of this paper is to highlight the work of this millenary legal institution in the conversion of extensive areas of uncultivated and unhealthy land into fértile crops and, on the other hand, to know the main characteristic notes of the emphyteusis in each peninsular territory.
