A proteção nos âmbitos externo e interno dos direitos humanos fundamentais : a pessoa humana, o Estado e a Corte Internacional de Justiça

Abstract

O presente trabalho visa contribuir com a temática de proteção de direitos humanos fundamentais nos âmbitos externo e interno, principalmente no tocante à competência da Corte Internacional de Justiça na análise de casos relacionados à direitos individuais, e igualmente, no estudo da inserção dos direitos fundamentais nas constituições do Brasil e de Portugal. A pessoa humana, os direitos fundamentais e sua evolução, o Estado e suas funções, e o acesso à justiça são temáticas abordadas, de modo a perceber não só a importância dos direitos humanos fundamentais, mas da mesma forma o desenvolvimento da proteção destes na esfera internacional e doméstica. O estudo é feito a partir da pessoa humana, fundamento de todos as outras concepções tratadas no trabalho, e então, perpassa alguns esclarecimentos sobre os mecanismos de garantia e efetivação de direitos, tendo como evidência na seara externa as decisões da Corte Internacional de Justiça. De forma a corroborar, portanto, são suscitados casos onde Estados demandam perante este Tribunal em defesa de seus nacionais, buscando a proteção de direitos individuais. O último exame versa sobre como estão dispostos Brasil e Portugal nos sistemas de proteção internacional de direitos humanos, bem como a acomodação dos direitos fundamentais em suas constituições. Constata-se que os direitos humanos ganharam muito espaço na discussão internacional, e inclusive na Corte Internacional de Justiça, mesmo esta sendo um Tribunal para Estados. Nota-se, aliás, a preocupação crescente dos Estados em relação à efetivação e garantia desses direitos dentro e fora de seu território, tendo o ser humano como primazia. Ainda, percebeu-se como se dá o diálogo entre o âmbito externo e interno, estando intimamente conectados em busca da justiça social e salvaguarda dos tão relevantes direitos humanos fundamentais.

This Master Thesis aims at contributing to the theme of protection of fundamental human rights in the external and internal spheres, mainly with regard to the competence of the International Court of Justice in the analysis of cases related to individual rights, and also, in the study of the insertion of fundamental rights in constitutions of Brazil and Portugal. The human person, fundamental rights and their evolution, the State and its functions, and access to justice are themes addressed, in order to understand not only the importance of fundamental human rights, but also the development of their protection in the domestic and international scopes. The study starts by conceptualizing the human person, the foundation of all other conceptions dealt with in this thesis, and then goes through some clarifications on the mechanisms of guarantee and enforcement of rights, taking as evidence in the external field the decisions of the International Court of Justice. In order to corroborate, therefore, cases are raised where States seek this Court in defense of their citizens, seeking the protection of individual rights. The last analysis deals with how Brazil and Portugal are prepared in the international human rights protection systems, as well as the accommodation of fundamental rights in their constitutions. It appears that human rights have gained much space in international discussion, and even in the International Court of Justice, even though this is a Court for States. In fact, there is a growing concern among States in relation to the enforcement and guarantee of these rights inside and outside their territory, with the human being as the primacy. Still, it was noticed how the dialogue takes place between the external and internal spheres, being intimately connected in search of social justice and safeguarding the most relevant fundamental human rights.
