Abstract(s)
A presente tese tem por objetivo discutir a problemática existente no sistema brasileiro de resposta penal à reação homicida sob o influxo da violenta emoção após injusta provocação da vítima. Adota-se como problema jurídico concreto a disposição legal que veda o reconhecimento da inimputabilidade em casos de emoção e paixão. As teorias filosóficas contemporâneas partem da convicção de que não é possível compreender a existência do homem sem considerar sua experiência emocional. Ao longo do século XX, os debates e as pesquisas sobre emoções e o sistema cognitivo ampliaram-se a outros campos do saber passando também pela psicologia, psicanálise e neurociências, cujos estudos, em uma visão mais integrada do ser humano, dirigiram-se às implicações do afastamento do dualismo cartesiano mente/cérebro. Na medida em que se reconhece o indivíduo como um conjunto complexo e indissociável, impulsionado à prática de crimes por amor, ira, paixão, ciúmes, desespero e dor, tônica explorada pela literatura científica e não científica igualmente, demonstra-se a necessidade da interlocução do Direito Penal com outras áreas do saber, em uma visão complementar e interdisciplinar. Sob este viés, a tese abordará, como questão central, o impacto da provocação no juízo de censurabilidade imposto ao autor do crime de homicídio, ao discutir questões afetas à violenta emoção sob enfoque dos estados passionais em sentido amplo, em situações não configuradoras de anomalia psíquica ou decorrentes de rupturas de relacionamentos amorosos. Apoiada no reconhecimento de que a opção legislativa disposta nos arts. 26 e 28, inc. I do Código Penal Brasileiro revela abordagem simplista ao descuidar da existência de efeitos emocionais intensos, retoma-se a discussão desta problemática sob outras lentes ao pensar um velho problema em uma nova perspectiva e concluir pelo inadequado tratamento da questão.
The present thesis aims to discuss the problem existing in the Brazilian system of criminal response to the homicidal reaction under the influx of violent emotion after unfair provocation of the victim. As a concrete legal problem, the legal disposition that prohibits the recognition of inimputability in cases of emotion and passion is adopted. Contemporary philosophical theories start from the conviction that it is not possible to understand the existence of man without considering his emotional experience. Throughout the twentieth century, debates and researches on emotions and the cognitive system expanded to other fields of knowledge, including psychology, psychoanalysis and neurosciences, which studies, in a more integrated view of the human being addressed to the implications of move away from Cartesian mind / brain dualism. To the extent that the individual is recognized as a complex and inseparable set, driven by the practice of crimes of love, anger, passion, jealousy, despair and pain, a tonic explored by scientific and non-scientific literature alike, the need for interlocution is demonstrated of Criminal Law with other areas of knowledge, in a complementary and interdisciplinary view. Under this bias, the thesis will address, as its central issue, the impact of provocation in the judgment of objection imposed on the perpetrator of homicide, when discussing issues related to the violent emotion under the focus of passionate states in a broad sense, in situations that do not configure psychic anomaly or stemming from broken love relationships. Supported by the recognition that the legislative option set forth in articles 26 and 28, I of the Brazilian Criminal Code, reveals a simplistic approach to neglecting the existence of intense emotional effects, the discussion of this problem is resumed in other lenses when thinking an old problem in a new perspective and concluding by the inadequate treatment of the issue.
