Mudança climática e movimento populacional

Abstract

presente dissertação de mestrado, entendendo que as mudanças climáticas configuram, hoje, um dos maiores desafios da modernidade, visa, considerando a feição multidisciplinar do problema, analisar a relação existente entre o problema da mudança global do clima e o deslocamento populacional tentando, de tal forma, demonstrar que: I) a existência de deslocados ambientais é uma realidade; II) o ordenamento jurídico internacional atual oferece meios capazes de estruturar uma norma voltada à proteção dos deslocados ambientais; III) existem soluções que podem ser adotadas a curto prazo; e, IV) é possível estruturar uma norma jurídicointernacional voltada especificamente para a proteção dos deslocados ambientais. Para tanto, buscando tratar o tema de forma conjunta, terá no centro da análise uma abordagem jurídica que pretende apresentar propostas capazes enfrentar o antecedente (mudança climática), para ajudar na solução do consequente (deslocados ambientais), e propostas direcionadas, especificamente, aos problemas dos deslocados ambientais. Nunca esquecendo que as alterações do clima constituem o principal impulsionador desta espécie de fluxo migratório. Para que, assim, sem a pretensão de esgotar o tema, este trabalho seja um contributo ao estudo da matéria.

This essay, understanding that climate change constitutes, today, one of the biggest challenges of modernity and considering the multidisciplinary feature of the problem, aims to analyze the relationship between global climate change and population displacement in order to demonstrate that: I) the existence of displaced person because of environmental reasons is an reality; II) the current international legal system provides guidelines to build a new framework of legal protection of environmental displaced persons; III) there are solutions that can be adopted in the short term; and, IV) it's possible to structure an international legal standard legal specifically for the protection of environmental displaced persons. Therefore, trying to treat the subject as a whole, we will focus on a legal approach that intends to submit proposals to tackle the previous problem (climate change) to help in solving the consequent problem (environmental displaced persons), and we will present proposals direct specifically to solve the environmental problems of the displaced persons, always bearing in mind that climate change is the main driver for this kind of migration. Though, without intending to be exhaustive, this work is a contribution to the study of the matter.
