A justiça no “continente de São Pedro” : um estudo histórico-jurídico do final do período colonial

Abstract

O tema da presente dissertação é a administração da justiça de primeira instância no território que atualmente constitui o Estado do Rio Grande do Sul e esteve sob o domínio de Portugal desde a ocupação oficial do canal de São Pedro até a independência do Brasil. O trabalho tem o objetivo de investigar a estrutura judiciária local, a sua forma, os ofícios adstritos à administração da justiça e as alterações ocorridas no arco temporal investigado. Para esse fim, o estudo remonta à formação da primeira vila nesse território, incluindo os aspectos de natureza de administração judiciária que determinaram a sua criação, e passa pela descrição e investigação da organização judiciária, observados os arquétipos trasladados da metrópole. O trabalho analisa, ainda, as alterações ocorridas nessa organização a partir de um pano de fundo histórico que envolve a transferência da família real portuguesa e a independência do Brasil. Esses eventos compreendem a criação de juizados de fora e divisões judiciárias, além de outros aspectos da estrutura judiciária, todos formativos de um arcabouço judicial para a então Capitania do Rio Grande de São Pedro. A realização da pesquisa envolveu material bibliográfico, fontes primárias e legislação, e o seu resultado está estruturado, nesta dissertação, em duas partes, nas quais se apresentam e discutem, em sequência cronológica, os eventos ocorridos em setecentos e em oitocentos. As conclusões abrangem, por exemplo, a constatação da existência de fases na administração da justiça local, considerações relacionadas à aplicação do direito material e reflexões tanto sobre as consequências da trasladação da coroa para o Brasil como sobre a criação de juízes de fora e a divisão judiciária.

The subject-matter of this study is the first instance’s administration of justice in the territory that currently constitutes the state of Rio Grande do Sul and was under Portuguese dominion from the official occupation of the São Pedro canal until the independence of Brazil. The purpose of the work is to investigate the local judicial structure, its form, the offices assigned to the administration of justice and the changes that occurred during the time are investigated. To achieve this purpose, the study goes back to the formation of the first town in this territory, including the aspects of the judicial administration that determined its creation, and goes through the description and investigation of the judicial organization, observing the archetypes brought from the metropolis. The work also analyzes the changes that occurred in this organization based on a historical backdrop that involves the transfer of the Portuguese royal family and the independence of Brazil. These events involve the creation of crown magistrate positions and judicial divisions, as well as other aspects of the judicial structure, all of which formed a judicial framework for the then Capitania of Rio Grande de São Pedro. The research involved bibliographical material, primary sources and legislation, and its result is structured, in this dissertation, in two parts, in which the events that occurred in the 18th and 19th centuries are presented and discussed in chronological sequence. The conclusions comprise, for example, the observation of the existence of phases in the administration of local justice, considerations related to the application of substantive law and reflections on both the repercussions arising from the transfer of the crown to Brazil and from the creation of its magistrates and the judicial division.
