Direitos fundamentais de mães encarceradas e de seus filhos menores numa perspectiva luso-brasileira

Abstract

O aumento do número de mulheres nas prisões é uma preocupação global, pois essas mulheres têm necessidades específicas de gênero que muitas vezes são ignoradas pelo Estado, responsável por garantir seus direitos fundamentais, incluindo a proteção de saúde, gestação, filhos e família. Este estudo investiga se os direitos fundamentais das mães encarceradas e de seus filhos menores estão sendo respeitados no Brasil e em Portugal, ambos comprometidos com as Regras de Bangkok das Nações Unidas, que orientam o tratamento de mulheres presas e a adoção de medidas não privativas de liberdade para mulheres infratoras. As medidas para cumprir essas regras têm se mostrado eficazes em manter a família unida e em respeitar a dignidade das mães e de seus filhos encarcerados. Há um conflito entre dois direitos: o cumprimento da pena pela mãe em regime fechado e o direito à liberdade dos filhos nascidos na prisão, que podem permanecer para amamentação e estabelecimento de vínculo nos primeiros anos de vida. A pesquisa analisa os direitos das mães encarceradas e de seus filhos, além das violações a esses direitos. As mães têm o dever de cumprir a pena em condições dignas e o direito de estarem com seus filhos até os seis anos de idade, garantindo proteção integral e desenvolvimento saudável para as crianças. A pesquisa também questiona até que ponto o ambiente carcerário pode prejudicar o desenvolvimento infantil nos primeiros anos de vida e destaca a importância da prisão domiciliar para mulheres grávidas ou com filhos até 12 anos de idade ou maiores com deficiência. As Regras de Bangkok contribuem parcialmente para o respeito à dignidade das mulheres no sistema carcerário, dependendo da execução em cada país. A pesquisa aborda as diferenças de tratamento entre Brasil e Portugal.

The increase in the number of women in prisons is a global concern, as these women have specific gender needs that are often ignored by the state, responsible for ensuring their fundamental rights, including the protection of health, pregnancy, children, and family. This study investigates whether the fundamental rights of incarcerated mothers and their minor children are being respected in Brazil and Portugal, both committed to the United Nations Bangkok Rules, which guide the treatment of women prisoners and the adoption of noncustodial measures for female offenders. The measures to comply with these rules have proven effective in keeping families together and respecting the dignity of incarcerated mothers and their children. There is a conflict between two rights: the mother's duty to serve a sentence in a closed regime and the children's right to freedom, who may stay for breastfeeding and bonding in the early years of life. The research analyses the rights of incarcerated mothers and their children, as well as violations of these rights. Mothers have the duty to serve their sentences in dignified conditions and the right to be with their children up to the age of six, ensuring full protection and healthy development for the children. The research also questions the extent to which the prison environment can harm child development in the early years and highlights the importance of home detention for pregnant women or those with children up to 12 years old or older with disabilities. The Bangkok Rules partially contribute to respecting the dignity of women in the prison system, depending on each country's implementation. The research addresses the differences in treatment between Brazil and Portugal.
