A criação dos direitos fundamentais e suas dimensões objetiva e subjetiva

Abstract

Este trabalho busca realizar uma análise histórica-jurídica dos direitos fundamentais, para que possamos compreender a importância da constante evolução desses direitos que, atualmente, não se limitam como meros instrumentos de defesa contra ingerências e intervenções estatais, mas também operam como base norteadora à manutenção e estruturação de um Estado Democrático de Direito, protetor, promotor e provedor das garantias fundamentais. Para tanto, buscamos desenvolver uma pesquisa com forte carga histórica, percorrendo pelo desenvolvimento e progresso dos direitos fundamentais em diferentes épocas dentro de distintos modelos de Estado governamentais, para depois abordarmos a teoria geracional desses direitos e, posteriormente, tecermos comentários sobre a natureza, características e problemáticas sobre titularidade. Acreditamos que todo este prévio estudo se mostra necessário e essencial à compreensão da dupla natureza dimensional dos direitos fundamentais, para depois analisarmos as consequências práticas de ambas as concepções, incluindo a teoria da eficácia horizontal. No decorrer e ao final do trabalho, com o intuito de elucidarmos nossa explicação, apresentaremos casos reais analisados pelos Tribunais brasileiros.

The objective of this paper is to conduct a historical-legal analysis of fundamental rights to understand the importance of their constant evolution. These rights currently are not merely instruments of defense against state interference and interventions but also serve as guiding principles for maintaining and structuring a Democratic State of Law that acts as a protector, promoter, and provider of fundamental guarantees. To achieve this, we aim to develop research with a strong historical component, exploring the development and progress of fundamental rights across different eras and governmental state models, and then analysis the generational theory of these rights. Subsequently, we will comment on the nature, characteristics, and issues related to their ownership. We believe that this preliminary study is necessary and essential to understand the dual-dimensional nature of fundamental rights, leading to an analysis of the practical consequences of both conceptions, including the theory of horizontal effect. Throughout and at the end of this work, to elucidate our explanation, we will present real cases analyzed by Brazilian courts.
