O Tráfico de Seres Humanos, crime organizado transnacional, é um dos graves reflexo da nova estrutura da sociedade internacional multicultural. A necessidade do seu combate eficaz demonstra ser imperioso o estudo da cooperação jurídica internacional em matéria penal. O presente estudo adota duas perspectivas: de um lado o “gigantismo” do crime de tráfico internacional de seres humanos, em seu caráter transnacional e a possibilidade de sê-lo combatido com o implemento de medidas de cooperação internacional, que possibilitam a colheita de prova no estrangeiro; e de outro lado a violação à garantia do contraditório, direito humano fundamental, das pessoas atingidas pelas medidas de cooperação jurídica internacional. Assim, a proposta dessa pesquisa abrangirá o indivíduo que seja atingido pelas medidas de cooperação no âmbito do procedimento probatório como um sujeito de direitos, o qual é, portanto, acautelado pelos direitos fundamentais humanos, destacado aqui o direito ao contraditório. Ademais, à luz dos Direitos Humanos, traça-se a possibilidade de se encontrar um ponto harmônico no contexto da divergência dos ordenamentos jurídicos dos Estados envolvidos em auxílio mútuo.
The Human Trafficking, transnational organized crime, is a serious reflection of the new structure of global society. The need for their effective prosecution proves to be urgent studying international legal cooperation in criminal matters. The current study adopts two perspectives: on the one side the "gigantism" of the international crime of trafficking of human beings in his transnational character and the opportunity to be it tackled with up the implement of international cooperation measures that enable the harvest of evidence abroad; and on the other side the violation of the guarantee of the contradictory, fundamental human right, of those affected by the measures of international legal cooperation. The proposal of this research reaches the person who is affected by the measures of cooperation within the evidentiary procedure as a person with rights, which is therefore safeguarded fundamental human rights: the right to adversarial. Moreover, in the light of Human Rights draws the possibility of finding a harmony spot within the context of the divergences between the legal systems of the states involved in mutual assistance.
