Violência doméstica: Da participação da ocorrência à investigação criminal

A violência doméstica constitui o quarto crime mais registado em Portugal e ainda se conhece pouco sobre o que sucede a estes casos, após a sua participação às forças de segurança. Por outro lado, são raros os estudos que em Portugal se debrucem sobre o processo de mudança das vítimas no que diz respeito à promoção da sua segurança ou sobre a sua colaboração no âmbito da investigação criminal. Este estudo incidiu sobre o processo que decorre entre a participação das ocorrências e o desenvolvimento do inquérito no âmbito da investigação criminal, concentrando-se na motivação das vítimas para a promoção da sua segurança, através de cinco estratégias diferentes, recorrendo-se ao modelo transteorético da mudança (Prochaska & Diclemente, 1982, 1992); na sua colaboração; e no resultado dos inquéritos (acusação/arquivamento).A investigação realizou-se no distrito de Lisboa, envolvendo 362 ocorrências de violência doméstica e 259 elementos policiais. Verificou-se que quanto mais elevados os níveis de motivação para a promoção da segurança maior é a colaboração das vítimas no inquérito, e que graus de colaboração elevados estão associados a um desfecho acusatório. De 117 dos casos em estudo, 5% resultou em acusação, devendo-se os arquivamentos, na maioria das situações, à falta de prova. São discutidas implicações para as políticas públicas no domínio da prevenção e combate à violência doméstica.
Domestic violence is the fourth most registered crime in Portugal, but still little is known about what happens to these cases. On the other hand there are few studies in Portugal that address the process of change in these victims regarding the promotion of their safety and their cooperation in the criminal investigation process. This study focused on the process that starts on the report of the occurrences to law enforcemen,t leading to the criminal investigation, concentrating on: victims' motivation to promote their safety, through five different strategies, using the transtheoretical model of change (Prochaska & DiClemente, 1982, 1992, their cooperation; and the results in terms of prosecution. This investigation was conducted in Lisbon. It was based on 362 cases of domestic violence and involved 259 police staff members. The results demonstrated that the higher the level of motivation to promote safety is, the higher is the level of cooperation, and that the high levels of cooperation are associated with a prosecution result. From 117 of the cases included in the study, 5% were prosecuted; the absence of prosecution, in the majority of cases, was due to the lack of evidence. Implications for public policy in the domain of prevention and fighting of domestic violence are discussed.
